Terms of Service and Conditions of Use

Article 1 – Parties and Scope

These Terms and Conditions of Service ("Terms") regulate the conditions of use for all services ("Services") offered through the website and online store operated by Medtex by Texmart ("Company").

In this text, the terms "we," "us," and "our" refer to Medtex by Texmart. The Services are provided using the Shopify infrastructure.

Anyone who visits, uses, or shops through the Services is deemed to have accepted these Terms.

  4. Return and exchange processes are carried out in accordance with the Return Policy.

  2. Unless otherwise stated, taxes, shipping, and other additional costs are not included in the price.

Article 7 – Shipping and Delivery

  2. The Company cannot be held responsible for delays caused by force majeure or shipping companies.

  3. Transfer of risk and ownership is subject to the relevant legislation and the provisions of the Distance Sales Agreement.

  2. They cannot be copied, reproduced, or used for commercial purposes without written permission.


Article 9 – Third-Party Services and Shopify

  1. The Services are provided with the Shopify infrastructure.

  2. Shopify is not responsible for obligations arising from sales transactions between the user and the Company.

  3. The site may contain third-party links; the Company is not responsible for the content and practices of these sites.


Article 10 – Privacy and Data Protection

  1. Personal data is processed in accordance with the Privacy Policy.

  2. Shopify and service providers may access certain data due to technical infrastructure requirements.

  3. The user declares that they have read and accepted the Privacy Policy.


Article 11 – Prohibited Uses

The user cannot:

  • Use the Services for unlawful purposes,

  • Upload harmful software,

  • Engage in spamming, fraud, or data scraping activities,

  • Infringe upon the rights of others.

In case of a violation, the Company reserves the right to suspend or terminate access.


Article 12 – Limitation of Liability

To the extent permitted by law, the Company cannot be held responsible for indirect, incidental, or consequential damages. This provision does not negate the consumer's rights arising from mandatory legislation.


Article 13 – Termination

The Company may suspend or terminate user access in case of a breach of the Terms.


Article 14 – Severability

If any provision is deemed invalid, the validity of other provisions will not be affected.


Article 15 – Governing Law and Jurisdiction

These Terms are subject to the laws of the Republic of Turkey. In case of disputes, the provisions of the relevant legislation will apply.


Article 16 – Right to Amend

The Company reserves the right to update these Terms. Updates will come into force on the date they are published on the site.
